My work experience includes various positions within the David Lawrence Mental Health Center. I conducted a two-year pilot program with the Department of Children and Families (formerly Health and Rehabilitative Services) intervening a select group of adults with high recidivism rates to the Crisis Stabilization Unit, State Mental Hospital and jail. I was also employed by the Collier County School District for 14 years working with pre-kindergarten age children with special needs and their families.

Cash bonds, generally referred to as "bail", are the payment made in cash to the jail. A surety bond, generally referred to as "bond", is posted on the defendant's behalf by a bail bond company to secure release from custody and appearance in court.
As of January 1, 2024, the State of Florida adopted a standard bail bond fee schedule that is the same in every county throughout the State of Florida. Most misdemeanors and third-degree felony charges carry a standard bond that can be posted at the time of arrest. There are exceptions; for instance, persons arrested for battery/domestic violence will have a "hold" to appear in front of a judge at a bond hearing within 24 hours of arrest, to have the bond and conditions of bond, set by the judge (SBJ). First appearance court is held every day, including weekends and holidays--even Christmas Day.
The premium fee for a bond is 10% of the penal amount of the bond with a minimum of $100. The rate is the same throughout Florida. For the most part, premium fees are nonrefundable. Our bond starts the moment a person is released from custody. If we post a bond and circumstances arise whereby the person is not released from custody of the sheriff, then we will return 100% of the premium. Additionally, if we post a bond and the defendant chooses a bond from another company, then we return 100% of the premium. A person remains on bond until the case is over (disposed).
Also, the outcome of the case does not have a bearing on the premium being returned.
Besides premium, the other essential part of a bond is collateral. Collateral is something pledged as security for repayment of a loan. Unlike premium, collateral is negotiable. For a $1,000 bond we require something pledged as security for repayment of the $1,000. For a $5,000 bond we require security for the repayment of $5,000. For a $50,000 bond we require security for the repayment of $50,000.
An Indemnity Agreement is used as collateral for every bond we execute. An Indemnity Agreement is something pledged, i.e., your signature, on the agreement stating you will hold us harmless against financial loss. This means that you promise to reimburse us if the person fails to appear in court, and as a result, the bond is "forfeited". (Forfeitures are discussed below.)
In some instances, the Indemnity Agreement by itself is not sufficient and we will require additional collateral such as cash. For example, a person travelling through Naples on their way from Miami to Tampa gets a $500 bond for DUI. They have no ties to the community and it's going to be more difficult to attend court hearings here and show up to all of them. In this case the risk of the bond being forfeited goes up if the person misses court. It would not make sense for me to profit $100 and increase my risk of losing $500. In this case I would collect $600--$100 for the premium fee and $500 for collateral. Any cash that is pledged for collateral must be returned within 21 days of the bond being discharged. (Not the premium fee.) For the person with the DUI, I would return $500 minus the credit card fee on the collateral.
Yes. As mentioned above, a Surety Bond is a bond posted on the defendant's behalf by a bail bond company to secure their release.
Another type of release is a Cash Bond. Rather than paying a 10% fee to a bail bond company, an individual, or their family member/friend, may pay the full amount of the bail, in cash, to the jail.
At First Appearance Cout bond is Set By Judge.
Typically, if the Judge establishes probable cause for the arrest exists, then a bond is set along with conditions of bond. If the Judge establishes that there is no probable cause for the arrest, then the defendant is released on his own recognizance (ROR).
If eligible, the Judge may allow a defendant to participate in the pretrial release program (PTR) in lieu of a bond. This program is administered by the Collier County Sheriff's Office.

Travel is allowed within the jurisdiction of the 20th Circuit Court. The 20th Circuit Court includes the five counties of Collier, Lee, Charlotte, Glades and Hendry. Travel outside of the jurisdiction of the 20th Circuit Court requires written permission from the Surety (Bail Bond Company) and/or the Court. In some cases, the Judge may order surrender of travel documents and restrict travel to only Collier County.
Individuals who are charged with battery cannot bond out of jail right away and are held until first appearance court where bond will be set by a judge. Typically, persons from the public are allowed to attend and observe the first appearance hearing--just not permitted to speak. The exception to this rule is that victims of domestic violence are granted permission to address the court. If the victim of domestic violence is not present, the court will most likely issue a "no contact" order and a "no trespass" order as a condition of bond. The defendant is not allowed to contact the victim or return to the residence during the pendency of the case.
Contact my office and I will inquire about the status of a warrant. Arrangements can be made to surrender at the Naples Jail Center/Collier County Jail or Immokalee Stockade. The court looks favorably on those who cooperate with the law.
The bail bond is forfeited when a defendant fails to appear in court. In addition, the Judge will issue a bench warrant for the defendant for failure to appear. In the likelihood the forfeiture is discovered on the same day, it may be possible to have the bench warrant and forfeiture set aside, given time. Contact your bondsman and your attorney immediately. If the forfeiture and bench warrant is not set aside the same day, it is important to stay in touch with your bondsman and attorney. The attorney may be able to file an order to set aside the bench warrant and the bondsman may be able to file an order to set aside the forfeiture. If the bench warrant cannot be set aside, the defendant will need to surrender themself to the Collier County Jail. Bail Bond amounts typically double the original amount when a person fails to appear. In certain situations, the bail bond company may be able to re-write the bond for free--given special factors.
Defendants released from jail, either through a bail bond or pretrial release program, must adhere to certain conditions. One of the most important conditions is for the defendant not to get rearrested on a new law violation while their case is pending. In most cases the offender will receive a new bond for the new arrest; however, the original bond or pretrial release may be revoked by the court. Having a bond revoked is equivalent to having "no bond". If there is "no bond" for the original arrest, then the person will have to stay in jail until the first case is over. After the first case is over, then a person can get out on the new charge. Do not get a new law violation!
Transfer bonds are an instrument used by Bail Bond Companies when a defendant is in custody in a different county or state. I am a registered, licensed bail bondsman in Collier County. If a defendant is located in a jail in a different county/state, I would have to seek a registered/licensed bondsman in that county to execute the bond on my behalf. There is an additional $100 transfer fee that goes to the bondsman writing the bond in the other county for their service.
On occasion someone may ask if I am willing to come off the bond and put a person back in jail because they are "messing up". I suggest that if you have to ask this question... it is probably better to not do the bond in the first place.
Part of the booking process involves a local, state and federal background check. U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations’ (ERO) mission is to protect the homeland through the arrest and removal of those who undermine the safety of our communities and the integrity of our immigration laws. Detainees who do not meet United States residency requirements are given a detainer by the U.S. Immigration and Customs Enforcement. This ICE Hold remains in place during the pendency of the criminal case. When the criminal case is disposed, the defendant will be transferred to an ICE detention facility where they will be held for a deportation hearing. In some cases, an "Immigration Bond" may be posted to release the defendant during the pendency of the deportation hearing.
Bail Bonds may be posted for an inmate who does have an ICE Hold while they are being held at the Naples Jail Center for their criminal case.
No. Some bail bond companies use software programs to obtain the phone numbers of an inmate's family members. Upon learning of a new inmate, these companies may initiate phone calls to the family without the inmate's permission. Although this practice is legal, Naples Bail Bonds values individual privacy rights and chooses not to engage in this method.
